These Terms of Use ("Terms") govern your access to and use of bathpro.leadbang.com (the "Site") operated by BathPro ("BathPro," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old and a legal resident of the United States to use the Site. By using the Site, you represent and warrant that you meet these requirements.

2. Nature of the Service

BathPro is a marketing and lead-generation platform. We connect consumers with independent, third-party contractors and service providers ("Service Providers") who offer bath and shower remodeling services. We are not a contractor, do not perform installation services, do not employ Service Providers, and do not endorse, certify, license, recommend, or guarantee any Service Provider, their work, materials, pricing, or qualifications.

3. Submissions & Consent to Contact

When you submit information through the Site, you consent to be contacted by BathPro and Service Providers as described in our Privacy Policy, including by phone, SMS/MMS, email, prerecorded messages, and automated dialing technology, even if your number appears on a Do Not Call list. You represent that any contact information you submit belongs to you and that you are authorized to provide it.

All content on the Site — including text, graphics, logos, images, and software — is owned by BathPro or its licensors and is protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

The Site may contain links to third-party websites and services. We are not responsible for the content, products, services, accuracy, privacy practices, or quality of any third party, including any Service Provider you are matched with. Any contract or transaction you enter into with a Service Provider is solely between you and that Service Provider.

THE SITE AND ALL CONTENT, MATCHES, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. BATHPRO MAKES NO WARRANTY REGARDING THE QUALIFICATIONS, LICENSING, INSURANCE, WORKMANSHIP, OR PRICING OF ANY SERVICE PROVIDER.

TO THE FULLEST EXTENT PERMITTED BY LAW, BATHPRO AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SITE OR ANY INTERACTION WITH A SERVICE PROVIDER. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

You agree to defend, indemnify, and hold harmless BathPro and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any law or third-party right.

10. Binding Arbitration & Class Action Waiver

Please read carefully. You and BathPro agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that you may bring an individual claim in small-claims court.

Class Action Waiver: You and BathPro agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

You may opt out of this arbitration agreement by sending written notice to the contact address below within 30 days of first accepting these Terms.

11. Governing Law

These Terms are governed by the laws of the State of [State], without regard to its conflict-of-laws principles. Subject to Section 10, any action not subject to arbitration must be brought exclusively in the state or federal courts located in [County, State], and you consent to personal jurisdiction there.
